Terms of Service

01Who we are

DDS-Networks is operated by an individual trading as DDS-Networks ("DDS-Networks", "we", "us", "our"), based in the United Kingdom. In these terms, "you" means the person using the services.

The way to reach us about anything in this document is through our Discord server. See section 19.

02The services

These terms cover this website and the following services, together with any other system we make available under the DDS-Networks name:

• Game Server Panel — panel.dds-networks.com
• Discord Bot — bot.dds-networks.com
• Radio Dispatch — radio.dds-networks.com
• MDT — mdt.dds-networks.com

The services are provided free of charge. We support our own gaming and development projects with them, and we may add, change, restrict, suspend or withdraw any part of them at any time.

03Who can use the services

You must be at least 13 years old to use the services. If you are under 18, you may only use them with the permission of a parent or guardian, who accepts these terms on your behalf.

Where a service is reached through Discord or another platform, that platform's own minimum age and rules apply as well.

You must not use the services if we have previously removed your access.

04Your account

Some services need an account. If you create one:

• give us accurate information and keep it up to date;
• keep your password and any access keys secure, and do not share them;
• do not let anyone else use your access, and do not use anyone else's;
• tell us as soon as you can if you think your account has been compromised.

You are responsible for everything done through your account. We may refuse, reclaim or rename an account where we reasonably need to.

05Acceptable use

You must not use the services to:

• break any law, or help anyone else do so;
• store, host, send or link to content that is illegal, infringes someone else's rights, or that you have no right to use;
• harass, threaten, defame, abuse or discriminate against anyone;
• gain or attempt to gain unauthorised access to any account, server or system, or to probe, scan or test the security of anything we run;
• bypass authentication, permissions, resource limits or any other control we put in place;
• upload or distribute malware, or run denial-of-service attacks;
• attack, exploit or disrupt any third-party service, game server or network;
• run workloads that abuse shared resources — including cryptocurrency mining, stress testing, spam relays, open proxies and bulk automated traffic;
• copy, resell, sublicense or commercially exploit the access we give you;
• reverse engineer or attempt to extract the source of our systems, except where the law says you may;
• scrape or bulk-collect data from the services beyond what we allow;
• impersonate anyone, or suggest you are affiliated with or endorsed by DDS-Networks when you are not.

You must also follow any additional rules published for a specific service or community — including our Discord server rules.

06Content you upload

You keep ownership of the files, configurations, messages and other content you put into the services. You are responsible for it, and you confirm you have the rights to use it.

So that we can actually run the services, you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit and display your content — only for the purpose of operating and supporting the services. This licence ends when the content is deleted, except where we have to keep a copy to comply with the law.

We do not routinely monitor content, but we may review it where we have reason to, and we may remove or disable anything that breaches these terms or the law.

07Backups and data

Keeping your own backups is your responsibility. We may take backups for our own operational reasons, but we do not promise that any backup exists, is current, or can be restored.

Server data, files and logs may be removed as part of maintenance, when a service is withdrawn, or after an account is closed. Do not use the services as your only copy of anything you cannot afford to lose.

08Availability

The services are provided free of charge and we do not guarantee that they will be available, uninterrupted, secure or error-free. There is no uptime commitment and no service level agreement.

We may take the services down for maintenance, upgrades or repairs, and we may change how they work. Where a planned outage is likely to affect you and it is practical to do so, we will try to give notice in our Discord server.

09Third-party services

The services connect to things we do not control — including Discord, game platforms, game servers, mods and hosting providers. Their own terms and policies apply to your use of them, and we are not responsible for them or for anything that happens on them.

10Suspension and termination

You can stop using the services at any time.

We may suspend or end your access, remove content, or close your account where:

• you have breached these terms or any service-specific rules;
• we reasonably suspect fraud, abuse or unlawful use;
• we need to protect the services, other users, or someone's safety; or
• the law or a competent authority requires it.

Where it is practical and lawful to do so, we will tell you why. We may also withdraw a service entirely, as set out in section 2.

When your access ends, your right to use the services stops immediately and we may delete your account, content and data. Sections that by their nature should survive — including sections 6, 11, 13, 14, 15 and 18 — continue to apply.

11Intellectual property

The DDS-Networks name, logo, branding, this website and the software and design behind our services belong to us or our licensors. Nothing in these terms transfers any of it to you.

We give you a limited, personal, revocable, non-transferable licence to use the services for their intended purpose while these terms apply. You may not use our name or logo to represent yourself as DDS-Networks, or in a way that suggests endorsement, without our written permission.

12Personal data

We process personal data in line with UK data protection law, including the UK GDPR and the Data Protection Act 2018. We only process what we need in order to run the services — for example the account details you give us, and technical records such as logs and IP addresses used to operate and secure our systems.

You have rights over your personal data, including the right to ask what we hold, to have it corrected, and in many cases to have it deleted. To exercise any of them, contact us as described in section 19.

13Disclaimers

The services are provided free of charge, "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations that are not expressly set out in these terms — including any implied terms about satisfactory quality, fitness for a particular purpose, accuracy, or uninterrupted availability.

If you are a consumer, this section does not affect your statutory rights.

14Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, and because the services are provided free of charge:

• we are not liable for loss of profits, business, revenue, goodwill or anticipated savings;
• we are not liable for loss, corruption or unavailability of data, files, configurations or server content;
• we are not liable for any indirect or consequential loss; and
• our total liability to you for all claims connected with the services is limited to £100.

We are not liable for anything caused by your breach of these terms, your own content, or a third-party service. If you are a consumer, we are not liable for business losses, and your statutory rights are unaffected. If you are using the services for business purposes, this section applies in full.

15Your responsibility to us

If someone brings a claim against us because of your content, your use of the services, or your breach of these terms, you agree to cover the reasonable losses, costs and expenses we incur as a result.

16Changes to these terms

We may update these terms — for example to reflect changes to our services or to the law. The "last updated" date at the top always shows the current version.

Where a change materially affects you, we will try to announce it on this site or in our Discord server. If you keep using the services after a change takes effect, you accept the updated terms. If you do not accept them, stop using the services.

17General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, we have not given it up.

You may not transfer your rights or obligations under these terms to anyone else. We may transfer ours, for example if the project is reorganised, provided your rights are not reduced.

These terms are the whole agreement between us about the services. Nobody other than you and us has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

18Governing law

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts where you live.
